Terms of Use and Service
BMHub — Terms of Use and Service
Operator: BMHUB LLC
Website: benchmarkshub.com
Contact: bmhub01@gmail.com
1. Scope and acceptance
These terms govern BMHub accounts, tools, reports and services. The commercial offering is directed to the United States market. Acceptance must be explicit and refer to the version presented; browsing or having an existing account does not itself accept new obligations. Terms acceptance does not replace informed authorization of recurring charges.
2. Accounts and security
Anyone creating an account must have legal capacity and authority when acting for another person or organization. Provide accurate information, protect credentials and report unauthorized access to the contact above. Do not share accounts to bypass permissions or limits. BMHub uses email verification, password and verification/recovery-token hashes, and revocable sessions. Absolute security is not guaranteed.
3. Permission to use and authorized work products
While you comply with these terms, you receive a limited, nonexclusive, nontransferable permission to use the available features under your plan. You may download reports and files BMHub allows you to export and use them in your professional, educational, or personal work, including sharing them with clients or collaborators when you have the right to do so. You must respect notices and licenses for incorporated sources. This permission does not authorize reselling the platform, distributing its code, or exploiting its materials as your own service without written authorization.
4. Intellectual property
Protectable BMHub materials, user work and third-party content retain their respective ownership and licenses. Identifying BMHUB LLC as operator does not itself transfer intellectual property or attribute others' rights to it. Use of the service does not transfer ownership of user files, photographs or work.
No exclusive rights are asserted over facts, general ideas, methods, functionality or public-domain materials merely because they appear in BMHub. No guarantee is made that AI-generated elements are registrable or protectable.
5. Prohibition on unauthorized copying and reproduction
Except with express written authorization, permission granted by these terms, or a right recognized by law or an applicable license, copying, reproducing, modifying, distributing, publishing, selling, sublicensing, or reusing BMHub’s protected code and materials, in whole or in part, is prohibited. Creating or commercializing a replica of the platform that incorporates those materials without authorization is also prohibited, even under a different name, logo, domain, or presentation.
Improper access to source code, internal systems, credentials, configurations, confidential information, or trade secrets is prohibited, as is bypassing access or payment controls, removing ownership notices, or reverse engineering, decompiling, or disassembling to the extent such restrictions are legally valid. No provision limits mandatory statutory exceptions or permissions granted by third-party licenses.
Noncompliance may give rise to responsibilities under applicable law and validly accepted conditions. No automatic penalty is established and infringement is not presumed merely from independently developing similar functions without incorporating others' protected materials.
6. Prohibited conduct and automated access
You must not use BMHub for unlawful activities, infringe others’ rights, impersonate others, introduce malware, obtain personal data without authorization, overload the service, or alter data to mislead. You must not bulk-extract protected materials or service databases, or use bots or automation to bypass limits, authentication, or plan conditions. Access through an authorized API is subject to its specific permissions and limits. These terms do not prohibit lawful consultation or reuse of public information from its original source.
7. Photographs, data and contributions
You retain the rights you hold in photographs, observations and files and must have permission to submit them. Avoid unnecessary personal data, secrets or others' confidential information. Photos/contributions identified as community content may be displayed to other users. Daily RTK files/packages are not offered to other users through product download functions; they require processing/storage by services and providers used to deliver those functions.
The author retains the rights in their photographs. By contributing a photograph identified as community content with the corresponding information and consent, the author grants BMHUB LLC a nonexclusive authorization to retain, host, process, adapt its format and display it within BMHub for the community function. This authorization continues after account closure; it does not transfer ownership or permit external advertising or unlimited sublicensing. Providers may perform technical processing necessary to deliver that function. The authorization remains subject to law and does not exclude legitimate privacy/copyright claims or applicable removal. No retroactive authorization is presumed for earlier contributions without the corresponding consent.
BMHUB LLC handles data requests, legitimate content claims and account-closure/deletion requests at bmhub01@gmail.com. Account deletion is handled manually; automatic self-service deletion is not offered. Closing an account does not itself remove community photos covered by the corresponding authorization. If removal is appropriate following a claim, it is handled separately from the benchmark's FOUND, NOT FOUND or POSSIBLE_FOUND status. Deleting a ZIP likewise does not itself erase observations, history, other versions or the whole account. Anonymization or total erasure is not promised.
8. External sources, maps, and benchmark data
BMHub may use information from public agencies, providers, and users. This information may be incomplete, outdated, or subject to reuse and attribution conditions. External links and their contents are the responsibility of their respective operators. Availability, completeness, or accuracy of an external source is not guaranteed.
Locations, elevations, descriptions, photographs, and statuses such as FOUND, POSSIBLE_FOUND, or NOT_FOUND are supporting information. They do not guarantee a control point’s current existence, accessibility, physical integrity, stability, or suitability. Users must verify the information necessary for their work in the field and through official sources.
9. Technical tools and Daily RTK
Calculation, automation, validation, and report-generation tools, including Daily RTK when available, require correct inputs and professional review. Users must verify, as applicable, units, reference systems, vertical and horizontal datums, geoid models, antenna heights, observation conditions, tolerances, and applicable requirements.
An automated result does not by itself certify a survey, elevation, particular accuracy, or compliance with professional standards. BMHub does not replace field verification, quality controls, or the judgment of a licensed professional. It must not be used as the sole basis for critical safety, construction, boundary, or certification decisions.
10. Legal Locator and artificial intelligence
The Legal Locator (Localizador Legal), when available, provides law and rule searches, references, excerpts, official links, and informational summaries. It does not determine rights, provide personalized legal advice, or establish an attorney-client relationship. Rules may change, and applicability depends on facts the tool may not know. Consult current official texts and an attorney when you need a legal determination.
When an official source is in English, that official text controls over BMHub’s informational translations or summaries. Artificial intelligence responses may contain errors, omissions, or incorrect references and must be verified. The use of artificial intelligence providers and handling of queries must be described in the privacy policy. Do not enter sensitive third-party information without authorization and a valid basis for its processing.
11. Plan, renewal, cancellation and refunds
BMHub Pro Monthly costs USD 15 per month plus applicable tax. It renews automatically each month until canceled. Features, limits, tax, renewal frequency and cancellation mechanism must be disclosed before purchase, with express informed authorization before charging. Terms acceptance does not itself authorize payment.
Cancellation stops the next renewal while Pro continues through the already-paid term. You may request cancellation at bmhub01@gmail.com; an end-of-term cancellation mechanism is also available inside BMHub when present in your account. A request is timely if received before renewal, not according to when it is opened or processed.
If renewal is charged because a timely received request was processed late, that renewal charge will be refunded. Other refund requests are reviewed separately and manually. No fixed window, percentage or absolute exclusion is established for those other requests. Mandatory legal rights remain unaffected. See Cancellation and Refunds for details.
12. Privacy and retention
The privacy notice describes accounts, cookies/identifiers, location, community contributions, job files, providers and AI functions. Terms acceptance is not consent to undisclosed data uses. Data and account-closure/deletion requests may be sent to bmhub01@gmail.com.
Keep the copies of files/results needed for your work. A file having no automatic expiration does not guarantee unlimited availability. Package deletion and account closure/deletion have different scopes.
13. Availability and access
The service depends on sources, providers and processing that may experience interruptions. Functions apply authentication, account-status, permission and license controls. Obligations/rights under validly accepted conditions and applicable law remain in force. Cancellation, invoice access and recovery must not be conditioned on accepting new contractual obligations.
14. Professional review and mandatory rights
Results may depend on incomplete or incorrect inputs/sources and require review appropriate to their use. No universal accuracy or suitability is guaranteed and professional judgment is not replaced. Responsibilities and warranties that cannot lawfully be excluded remain unaffected.
15. Content and rights complaints
Send complaints to bmhub01@gmail.com identifying the material, its location and the right asserted. Provide only information needed to assess the matter; do not send passwords or unnecessary personal documents. Additional information may be requested to verify the request.
If communicating a complaint to the contributor is necessary, disclosure will be limited to information relevant/necessary for a response, avoiding contact details, personal documents or unrelated information unless authorized or legally required. This channel does not replace mandatory legal procedures or designate an agent under a specific legal regime.
16. Changes to these terms
Updated versions will show their effective date. Material changes must be clearly notified through available means, and renewed acceptance requested when necessary. Changes will not apply retroactively to alter accrued rights. Merely changing text on a webpage does not by itself constitute an existing user’s acceptance of new obligations.
17. Questions and disputes
Questions/complaints may be sent to bmhub01@gmail.com. This contact does not limit urgent relief, legal deadlines or rights/remedies under applicable law.
